We at Goodcall AI Inc. and our affiliates (“Goodcall” “we”, “us”, or “our”) have created this Privacy Policy to describe how we collect and use personal information from and about the visitors to our website at www.Goodcall.com (the “Site”) and authorized users (“Users”, and collectively with Site visitors, “you”, “your”) of the companies that are customers of the Goodcall platform (our “Customers”), and the choices that you have with regard to how we use your information.

This Privacy Policy applies to our Site, mobile features, and any other interactive features or services owned or controlled by Goodcall that post a link to this Privacy Policy (each, a “Service” and collectively with the Site, the “Services”). This Privacy Policy does not govern information collected from our Customers’ customers and other end users when they interact with the Services, such as through talking with our artificial intelligence customer support assistant (“AI assistant”) through a Customer’s designated phoneline; these activities are governed by our agreement with that Customer and the Customer’s privacy policy.

This Privacy Policy explains what personal information we collect from Users, how we use and share that information, and your choices concerning our data practices. This Privacy Policy is incorporated into and forms part of our Terms of Service.

Before using the Services or submitting any personal information to us, please review this Privacy Policy carefully and contact us if you have any questions. By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the Site or otherwise use the Services.

  1. INFORMATION WE COLLECT

We collect information that, alone or in combination with other information in our possession, could be used to identify you as follows:

Information You Provide: We collect the following categories of personal information when you register and use the Services, request information about or a demo of the Services, sign up for our newsletter, or otherwise interact with Goodcall:

  • Identification Information: We collect your name, email address, phone number, and account information (such as a password or other information that helps us confirm that it is you accessing your account).

  • Financial Information: Our payment processor, Stripe, will collect the financial information necessary to process your payments, such as your payment card number and authentication details. Please note, however, that we store only a tokenized version of such information and do not maintain payment card information on our servers.

  • Communication Information: We may collect information when you contact us with questions or concerns and when you voluntarily respond to questionnaires, surveys or requests for market research seeking your opinion and feedback. Providing communication information is optional to you.

  • Social Media Information: We have pages on social media sites like Twitter and LinkedIn (“Social Media Pages”). When you interact with our Social Media Pages, we will collect personal information that you elect to provide to us, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages.

Internet Activity Information: When you visit, use, and interact with the Services, we may receive certain information about your visit, use, or interactions. For example, we may monitor the number of people that visit the Services, peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access the Services (e.g., Chrome, Firefox, Microsoft Internet Explorer, etc.), broad geographical information, and navigation pattern. In particular, the following information is created and automatically logged in our systems:

  • Email Open/Click Information: We use pixels in our email campaigns that allow us to collect your email and IP address as well as the date and time you open an email or click on any links in the email.

Information Provided By Our Customers: If you are a User, the Customer granting you access to the Services may provide your personal information to us. This personal information includes, but is not limited to, your name, email address, log-in information, phone number, and any other personal information our Customers may choose to provide.

Information We Process Through AI Assistant: In order to provide the Services, we process the information and requests received via AI Assistant, such as a request for the location or hours of operation of one of our Customers. Personal information about our Customers’ customers and end users that may be made available during communications with AI Assistant is processed pursuant to our agreements with those Customers. We have no direct relationship with the individuals whose personal information we process on behalf of our Customers. If you are such an individual and would no longer like your information to be used by one of our Customers or if you would like to access, correct, or request deletion of your information, please contact the Customer that you interact with directly.

Additionally, the AI Assistant feature includes saving audio and the transcription from calls, both to enable the AI Assistant and to train and improve the models that the feature is based on, such as speech recognition and understanding. Goodcall may use pseudonymized segments of such transcriptions and recordings to improve or validate the Services, or securely share it with contractors to do so on Goodcall’s behalf. Any training data saved by Goodcall is used only for improving Goodcall’s language models and is processed primarily by automated systems. A small fraction of training data may be manually reviewed. You may opt out of manual review at any time by contacting [email protected].

Cookies: We use cookies to operate and administer our Site, gather usage data on our Site, and improve user experience on our Site. A “cookie” is a piece of information sent to your browser by a website you visit. Cookies can be stored on your computer for different periods of time. Some cookies expire after a certain amount of time, or upon logging out. These are known as session cookies. Other cookies survive after your browser is closed until a defined expiration date set in the cookie (as determined by the third party placing it). Online Tracking and Do Not Track Signals: We and our third party service providers may use cookies, pixels, or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Site and may use that information to send targeted advertisements. Our Site currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do respond to DNT signals in the future, we will update this Privacy Policy to describe how we do so.

  1. HOW WE USE YOUR INFORMATION

We may use information about you, including personal information, to: (1) provide the Services; (2) process a transaction you initiate; (3) process your registration with our Services, including verifying your e-mail address is active and valid; (4) improve the Services and our products, and for internal business purposes, including the measurement of marketing effectiveness; (5) prevent fraud, criminal activity, or misuses of our Service, and to ensure the security of our IT systems, architecture, and networks; (6) communicate with you regarding your use of the Services and, in our discretion, changes to our policies; (7) comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties; and (8) as described in the Privacy Policy and for purposes disclosed at the time you provide your personal information.

We may also use your personal information to contact you about information, newsletters, products, services, or suggestions you request or may be interested in. For instance, if you elect to provide your email or sign up for our newsletter, we may use that information to send you special offers. You may opt out of receiving promotional emails by following the instructions contained in each promotional email we send you. In addition, if at any time you do not wish to receive future marketing communications, you may contact us at [email protected]. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding management of your account, other administrative matters, and to respond to your requests.

We may aggregate personal information collected through the Services and use the aggregated information, which does not identify you, to analyze the effectiveness of our Services, to improve and add features to our Services, to train AI Assistant, and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of Users of our Services and visitors to our Site, and share aggregated information, like general user statistics, with prospective business customers. We may collect aggregated information through the Services, through cookies, through AI Assistant, and through other means described in this Privacy Policy.

  1. INFORMATION SHARING

We may share your personal information, without further notice to you unless required by applicable law, as described below or otherwise in this Privacy Policy:

  • Our Customers: Because we provide the Services on behalf of our Customers, we may share certain personal information with the Customers on whose behalf you are communicating through the Services.

  • Service Providers: We will share your personal information with unaffiliated entities that assist with our provision of the Services to our Customers, such as companies that provide hosting and other IT services, send messages and emails through the Services or on our behalf, offer customer service, process payment information, or target and serve our advertisements. To the extent feasible, these service providers are subject to confidentiality obligations which limit their use and disclosure of such information.

  • Administrative and Legal Reasons: We may also disclose your information, including personal information, in response to a subpoena, court order, or when otherwise required by law; in response to bankruptcy proceedings; to defend our rights; in response to a request from law enforcement; to provide information to a claimed owner of intellectual property who claims that content you have provided to us infringes on their rights; to protect and/or defend any applicable Terms of Service or other policies applicable to the Services; or to protect the personal safety, rights, property or security of any organization or individual.

  • Business Transitions: Goodcall may share personal information with our parent, subsidiaries, affiliates, and investors primarily for business and operational purposes so long as any recipient agrees to comply with this Privacy Policy and applicable law with regard to such personal information. In the event that we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, bankruptcy, or other corporate change, including, without limitation, during the course of any due diligence process, your information, including personal information, may be among the assets transferred or otherwise disclosed.

  • With Your Consent: We may share your personal information with third parties with your consent (if permissible under applicable law) provided at the time you provide us with information.

We may share non-personal information, such as aggregate or de-identified user statistics, demographic information, usage information, and related insights with our Customers and third parties, including industry parties, advertisers, content providers, and analytics providers, for our marketing and advertising purposes.

We may anonymize your personal information so that you are not individually identifiable, and provide that information to certain of our Customers to help us improve our Services, such as sending anonymized samples of audio or text to a third party to improve speech-to-text transcription and reading comprehension. We may also provide aggregate usage information to our Customers to understand how often and in what ways people use our Services. However, we never disclose aggregate usage information to a Customer in a manner that would identify you personally, as an individual.

  1. CHILDREN

Our Services are not directed to children who are under the age of 16. We do not knowingly collect personal information from children under the age of 16. If you have reason to believe that a child under the age of 16 has provided personal information to us through the Services please contact us at [email protected] and we will endeavor to delete that information from our databases.

  1. THIRD PARTY CONTENT AND SERVICES

Certain content provided through the Services may be hosted and served by third parties, including our Customers, and may include links to third party web sites or content over which we have has no control and which are governed by the privacy policies and business practices of those third parties. Please also note that our content and widgets may be included on web pages and web sites that are not associated with us and over which we have no control. These third parties may independently collect data. We are not responsible or liable for the privacy practices or business practices of any third party.

  1. SECURITY

We implement commercially reasonable technical, administrative, and organizational measures designed to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Services or e-mail. Please keep this in mind when disclosing any personal information to us via the Internet.

  1. INTERNATIONAL USERS

The Services are operated in the United States and intended only for Users located in the United States. However, if you access the Site or the Services from outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Services, submitting any information on the Site, or otherwise providing us with any information, you fully understand and acknowledge this transfer, processing and storage of your information in the United States.

  1. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy at any time and any changes will be effective upon posting. Upon any update the “Last Updated” date at the top of this policy will be updated. We encourage you to regularly check this Privacy Policy for any such updates. Your continued use of the Services following an update to this Privacy Policy will constitute your acceptance of the updated Privacy Policy.
